The Supreme Court clarified the procedure for considering disputes in the presence of two conflicting judicial acts
The Supreme Court considered that the court of general jurisdiction did not refute the conclusions of the arbitration court on the transit nature of security transactions to build up intra-group accounts payable.
Anton Makeychuk, a lawyer and partner of the law firm Tenzor Consulting Group, believes that the definition of the Supreme Court added to the “piggy bank” of definitions, in which the Court moved away from a formal approach and considered the dispute, together with all the circumstances of the case, in a complexly constructed relationship.
