The government drew attention to the bankruptcy of insurance companies
You can find up-to-date information on the implementation of resolutions on the official website of the Ministry of Justice. The figures show that many of the COP’s instructions have not yet been implemented.
When monitoring law enforcement in certain branches of legislation, the government identified the need to unify the regulation of bankruptcy of insurance and credit organizations. In particular, it was found that the rules on bankruptcy of credit institutions provide protection of the interests of creditors to a greater extent than the regulation in relation to insurance companies.
Anton Makeichuk, a lawyer and partner of the Tenzor Consulting Group law firm, noted in a commentary for the Advokatskaya gazeta that there are also problematic points in the field of bankruptcy of ordinary commercial organizations, in some places already resolved by judicial practice, but not regulated by the federal legislator (for example, new sub-lines).
At the same time, the legislation in the field of insolvency of credit institutions is more developed, the expert believes.
