Tenzor Consulting Group lawyers successfully defended the principal in the court of cassation
In the context of a bankruptcy case of Inga JSC, initiated by PJSC Bank Trust, the latter applied to bring a claim for vicarious liability against the debtor’s controlling entities.
Previously, the claim of PJSC Bank Trust was included into the register of creditors’ claims in the amount of RUB 24,200,785,513.68.
Representing one of the defendants, the lawyers of Tenzor Consulting Group appealed against the ruling on the inclusion of the bank’s claim into the register of creditors’ claims, indicating the priority of the claim should have been downgraded.
The Court of Appeal did not see any grounds for subordinating the bank’s claims, in connection with which Tenzor Consulting Group lawyers filed a cassation appeal.
The court of cassation considered the position of the lower court unfounded. Based on the results of consideration of the cassation appeal, the court agreed with the applicant’s arguments, and a dispute on the inclusion of bank’s claim into the register of creditors’ claims was sent for reconsideration.
