An increase in the salary of a lawyer and the payment of bonuses to him on the eve of the bankruptcy of an enterprise may be justified
As explained by the Supreme Court, the presence in the Bankruptcy Law of special rules on challenging transactions (actions) does not deprive ordinary employees of a bankrupt organization of the right to receive the entire complex of labor guarantees.
Anton Makeychuk, a lawyer and partner of Tenzor Consulting Group, commenting on this case for Advokatskaya Gazeta, called the ruling of the Supreme Court of the Russian Federation remarkable by the fact that, given the existence of special rules on challenging transactions in bankruptcy legislation, the court quite rightly stood up to protect the rights of ordinary workers to receive guarantees established by the Labor Code.
