The lawyers of the Tenzor Consulting Group, representing the interests of the defendant, a large instrument-making plant, in a lawsuit against JSC Rusatom Automated Control Systems, were able to reduce the amount of claims by more than 10 times.
The plaintiff demanded payment of a penalty for the delay in the obligation to install equipment at one of the nuclear power plants. During the proceedings at the International Commercial Arbitration Court, the Tenzor Consulting Group lawyers were able to prove that the deadlines for fulfilling the obligations stipulated by the work schedule were violated for objective reasons - as a result of improper performance of duties by the plaintiff company and its contractors.
The panel of arbitrators composed of V.V. Vitryansky, D.E.Baranov and I.G. Tsyganenko accepted all the arguments of the defense: if the improper fulfillment of obligations occurred through the fault of both parties, then the amount of liability of the debtor should be accordingly reduced.
